The Provider - Photobooth Emporium
The Customer - The Person(s) / Company booking Photobooth Emporium for their event.
Booking Form - The online Booking Form contained on our website or any signed and or printed version of this form.

The following contract and its terms will set forth an agreement between the provider and the customer for the hire of the photo booth.

This written contract sets forth the full, written intention of both parties and supersedes all other written and/or oral agreements between the parties.

Service Period

Provider agrees to have a Photo Booth operational for a minimum of 80% during this period; operations may need to be interrupted for maintenance of the photo booth (eg restocking photo paper).


A 50% non-refundable deposit is required at the time of booking a photo booth to secure the date. Larger or corporate events may require a larger deposit. The remaining balance is due 7 days prior to your event.

If the operator has to use the equipment for a time period in excess of the hire period agreed, the additional time will be billed to the customer at the following rates:
R 1000.00 per additional hour of use.

Idle hours are charged at R 350.00 per hour.

Payment for any additional time required must be paid before any additional hours are provided.


In the unlikely event that the Provider is unable to supply a working photo booth for at least 80% (including occasional maintenance time) of the agreed service time, depending on the conditions we will either stay for a longer time period to compensate for the lost time, or the Customer shall be refunded a pro-rated amount based on the service received.

If the printer fails to print out the photos on site, the Provider will print all photos saved from the event on the CD Folio and delivered it to the Customer free of delivery charge.

Date Changes & Cancellations

Any request for a date change must be made in writing at least thirty days (30 days) in advance of the original event date. Change is subject to photo booth availability and receipt of a new booking agreement. If there is no availability for the alternate date, the deposit shall be forfeited and the event cancelled.

Any cancellation will forfeit any deposit payment made.

Your deposit is non refundable, however we will move your hire date if possible.

Your final payment is non refundable unless Photobooth Emporium do not provide a photo booth hire for you.

Access, Space & Power for the Photo Booth

The Customer will arrange for an appropriate sized space for the Photo Booth at the event venue. Booth Specs are: 2m x 2m x 2.1m high.

We also require a space for the Props Box. Box Specs are 0.6m deep x 1m wide x 0.6m high.

Should you choose the Guest Book Service, we would also require a small table and a chair, so your guests can sit and write their personal messages.

The Customer is responsible for providing adequate power within 10m from the Photo Booth. We do not have battery backup for the photo booth so please confirm with your venue that they do.

Photobooth Emporium will deliver the photo booth to your event venue. If the venue obstructs us from delivering the Photo Booth we are not responsible for lost hours of service. Examples of obstructions are: Denied access/area allocated is not, or the venue does not allow photo booths. Please check with your venue that photo booths are allowed.

You must ensure there will be suitable parking facilities for our staff at your chosen venue for the duration of your booking for reasonable access.

It is your responsibility to supply the correct address and times for the chosen venue.

Guest Book

Guestbook styles and designs may vary due to stock supplies. Guests will be given two printouts and inform that one is for your guestbook and one for them to keep. It is not Photobooth Emporium's responsibility if those pictures are not placed in the guest book. Any damage to the guestbook during the event is not Photobooth Emporium's responsibility.

Our professional Photobooth Butler will be onsite to make sure the booth is fully operational and to help with guest book if required.

Force Majeure

In the unlikely event of total photographic or power failure, injury or sickness beyond our control, our liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected.

Damage To Provider's Equipment

The Customer acknowledges that it shall be responsible for any damage or loss to the Provider's Equipment caused by any misuse of the Provider's Equipment by the Customer or its guests.

Termination of Hire/Abuse/Threatening behaviour

Photobooth Emporium will not tolerate any abuse or threatening behaviour to any of our staff or abuse of the booth or booth equipment. If this occurs Photobooth Emporium retains the right to terminate the hire immediately. This applies equally to you and your guests. Photobooth Emporium may terminate the hire in cases where our staff feel the equipment belonging to Photobooth Emporium or the booth itself is in danger of being damaged or has been damaged due to the actions or unruly behaviour of you or your guests.

Wherever possible and reasonable to do so we will speak with you or the venue first to try to resolve the matter before any termination is enacted. If we do terminate, for any reason, the full cost of hire will remain due and we will not issue any refunds for any period of hire not provided.

Events beyond our Control

Photobooth Emporium cannot be held responsible for any circumstances that may prevent us from attending your event; these may include, but are not limited to severe weather conditions, traffic delays, breakdown of our vehicles, sickness or equipment failure.

In the case that we cannot attend or fulfill your hire due to events beyond our control we will contact you or the venue as soon as possible. In these instances our liability will be limited to the refunding of all of monies paid.


Our booths outer skins can be branded and replaced with your company branding at an additional cost.

The measurements will be given to you and you can send the artwork. Alternatively we can provide the art work at an additional cost.

Artwork needs to be approved via email in writing by customer before going to print.


The Customer agrees to, and understands the following:

  • The Customer will indemnify the Provider against any and all liability related to the Customer's Event during or after Customer's event. The Customer will indemnify the Provider from the time of service and on into the future, against any liability associated with the Customer.

  • The Customer will indemnify the Provider against any and all liability associated with the use of any pictures taken within the Photo Booth, by its representatives, employees or affiliates at the Customer's event.

  • The Customer will indemnify the Provider against any and all liability associated with the quality of the sound due to background noices of any videos recorded within the Photo Booth, by its representatives, employees or affiliates at the Customer's event.

  • Customer agrees to the following statement:
    The Standard Props are a free addition to the photo booth hire and if for any reason the free additions are not working or available, the Customer is not entitled to a refund.

  • Customer agrees to the following statement:
    Guests will be allowed to partake in unlimited amount of photo sessions for the duration of the booking, but there will be no reprint options. We will print 2 x 2"x6" duplicate photo strips or 1 x 4"x6" postcard print per sitting/session.

  • The Customer agrees to, and understands the following:
    All guests using the photo booth hereby give to Photobooth Emporium: The right and permission to copyright and use all photographic portraits or pictures and email addresses of any photo booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose.

    In addition, I hereby release, discharge and agree to save harmless Photobooth Emporium, from any liability, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.
